It is best not to choose a national holiday as your last day of employment, because an accountant who thinks she personally embodies the Labor Standards Act will proactively change your last day to a weekday and claim that the Labor Standards Act stipulates that a national holiday cannot be a last day of employment.
Some people may not know the distinction: if the last day of employment is not the last day of the month, the company does not have to pay that month's NHI premiums; the employee must pay the full amount.
Please read the Labor Standards Act carefully: If, before resigning, an employee has clearly notified the employer in advance of the contract termination date within the periods prescribed in Article 15, Paragraph 2, and Article 16, Paragraph 1, of the Labor Standards Act (hereinafter, the same Act), that date is the contract termination date. Furthermore, if the contract termination date notified by the employee to the employer falls on a holiday, the law does not expressly prohibit this. If the employer considers it necessary to change or adjust the date after receiving the aforementioned notice, the employer may do so only after negotiating with and obtaining the employee's consent; it may not change the date unilaterally.
