Is it legal to deduct annual leave for a typhoon day off?
Some users have reported that employers require “using employees’ own annual leave to offset typhoon leave; otherwise, no pay will be provided.” This is illegal. The Ministry of Labor stipulates that typhoon leave cannot be replaced by any other form of leave or leave category. In addition, the Labor Standards Act provides that workers may freely arrange the dates of their special leave. Unless an agreement is reached through consultation, employers may not interfere for any reason with special leave that workers have already scheduled.
