Pros

Our company has been maliciously smeared by a former employee, anonymously defamed, and subjected to interference with its business reputation. After persuasion proved ineffective, this case entered judicial proceedings on 2021-09-11.

I am the person in charge, Jian Wei-en, and I bear legal responsibility for every statement I make.

I would like to say a few words to “Ms. Chiayi Li,” a former employee who voluntarily resigned on June 18, 2021.

It was difficult to establish this company and get it to where it is today. Whether regarding division of duties, work rules, training in concepts, salaries and bonuses, or the profit-sharing system, everything was regulated and clearly explained upon joining, and we have continuously improved employee benefits.

When you applied for the job, we also clearly told you that we seek innovation and change and adjust to respond to the market—that every day here is a war!

If you want to work peacefully in a stable, unchanging enterprise, this place will not be suitable for you! You agreed and also signed a labor services agreement.

This is a company that improves and corrects its shortcomings every day. Everyone works hard to move toward our goals, and you were once part of it.

At the same time, we respect every employee by giving them the greatest possible degree of freedom at work, and we update our partners as much as possible about the company’s current situation and goals.

I often say that a company is like a sports team: everyone is responsible for their own position, and together we move toward a common goal.

Perhaps one day what you want will be different. It may not entirely be the company’s problem; perhaps your goals have changed. It is that simple. You can change battlefields and start again, and we will also offer our blessings!

Ms. Li, during your employment you held an important position in the company and had the highest level of authority. You were highly respected, developed by the company, and given the most resources. As the person in charge, I placed extreme trust in you. I only asked you to improve your work processes and your attitude toward vendors, colleagues, and customers, to act reasonably, and to cooperate with company policies in addressing new tasks and development needs. Who would have thought that this would not suit you?

You were unwilling to accept guidance from supervisors and insisted on working according to your own methods. You spread rumors and false statements, and your work attitude deteriorated in the later period. These matters do not need to be discussed.

Before resigning, you violated work rules and caused actual losses to the company in connection with certain cases. When supervisors and colleagues asked about it, you were unwilling to respond. Skipping this part,

let us speak directly about what you did after resigning and how it affected the company and me.

1. You deliberately approached senior employees of our company and induced them to take screenshots of important group-chat messages containing internal company information, financial information, and other materials.

2. You induced current employees to use our company’s resources for your own profit-making activities outside the company.

3. You spread rumors and sent text messages to multiple current employees telling them not to come to work.

4. You posted false comments about our company on major job-search platforms.

I will simply mention these few points; I will not describe the others one by one.

Anonymous reviews on major job-search platforms are your freedom, but I would also like to use this platform to say to you: If this company was really so terrible and caused you so much harm, why did you stay here for nine months? Was I controlling you? If there were illegal matters, why did you not pursue legal channels?

1. Why did you incite so many current employees to resign, yet no one listened to you?

2. You used the LINE messaging app multiple times to send messages to our current employees. Why did they not respond to your messages?

3. You called the company several times. Why did they not answer your calls?

Ms. Chiayi Li, please think carefully about the harm caused by everything you have done to us today.

“I firmly believe in the cycle of cause and effect; when the time comes, it will surely return to oneself.”

I tolerated you for more than a month. I also sent a 200-character message to hear your concerns and asked people connected to both of us to persuade you.

I intended to reconcile with you, but it was useless... Ms. Chiayi Li would not accept it. Then we will see each other in court!

Anonymous posting online may mean you do not have to take responsibility; with the keyboard in your hands, there is nothing I can do!

Cons

1. Because resources were scarce when the company was newly established, I, as the person in charge, did not fully understand the rights and interests of both employers and employees. Simply put, I did not understand the law and thought that verbal agreements with employees would be sufficient as long as both parties reached a consensus. Little did I know that much of the content violated Taiwan’s great Labor Standards Act!

Everything was fine during the period of employment, and there were hardly any problems.

When it came time to resign, you wanted to argue over everything, and suddenly nothing counted—the Labor Standards Act was paramount!

Thank you to the anonymous reviewer, who may be the former employee who voluntarily resigned, Ms. Chiayi Li, for teaching me how to conduct myself, helping me understand the principles of society, and broadening my horizons. I am grateful to you and wish you all the best.

As for the Labor Standards Act, no problem.

All right, we will definitely comply.

We also immediately hired professionals to draft a new labor services contract and review it for any provisions that disregard employee rights and interests or violate the law.
