Exclusive / Security guards work excessive overtime without receiving pay; employer: employees voluntarily arranged the shifts. Reporter: Hsieh Pei-ying / Photographer: Chao Kuo-jui, Taipei report, 2015/12/01 18:07. Many people have surely seen the security guards and bodyguards beside entertainers and celebrities. Although they look glamorous, the work is not easy at all; they often work overtime and must be available for on-call assignments! A security guard has now filed a complaint. Although they are dispatched security guards employed by the company and their work requires a high degree of flexibility, overtime is common, yet they have not received the legally required overtime pay with the applicable premium. The company has not even enrolled them in Labor Insurance and National Health Insurance. However, the employer responded that the overtime was voluntarily scheduled by the employees and was not forcibly arranged by the company. The Labor Affairs Bureau stated that overtime pay must be provided whenever employees work beyond regular hours.

Mr. Fan, an employee of Huade Security: “There are 30 days in a month, and I work all 30 days. The company has not enrolled me in Labor Insurance or National Health Insurance as required, and has not paid the supplementary premiums either.”

Holding his work records, Mr. Fan was furious. He works in security and works all 30 days of the month without any rest. Not only has he failed to receive the legally required overtime premium, he has not even been covered by regular Labor Insurance and National Health Insurance.

Mr. Fan, an employee of Huade Security: “A person’s normal working hours should be 360 hours a month, but I actually worked as many as 600 hours, and the company simply ignored it.”

Ms. Chiu is also involved in a labor dispute. Seven months ago, she received her last assignment, and she has effectively had no income during this period.

Ms. Chiu, an employee of Huade Security: “After I finished my last assignment, the company did not arrange any work for me for seven months, so I had no income for seven months.”

They originally worked for Huade Security and handled many assignments, including security work for entertainers. For example, when entertainer Lin Yu-hsing got married the year before last, the company was responsible for maintaining order at the wedding. Guests such as Chu Ke-liang and Li Lo were among the clients they had previously worked with. However, the company is now in conflict with its employees over overtime pay and Labor Insurance and National Health Insurance issues.

Ye Chin-chia, general manager of Huade Security: “At the time, he said he did not want to participate because he wanted to join the union. Of course, I respected his wishes. He was a supervisor and made his own schedule. He wanted to earn money, and we also told him not to do that.”

Yeh Chien-neng, director of the Labor Standards Division of the Labor Affairs Bureau: “For the first two hours of extended work, pay should be increased by one-third. Units with more than five employees are required to enroll them in Labor Insurance and National Health Insurance.”

Security company contracts are often won through price-cutting bids. Receiving fewer contracts directly affects the livelihoods of dispatched employees. The Labor Affairs Bureau has now begun an investigation.
