Taiwan Hsinchu District Court Civil Judgment 100 Annual Chu Zi No. 154
Petitioner Far Eastern Medical Electronics Technology Co., Ltd.
Legal representative Deng Junnan
In the above matter concerning the petition to declare a check invalid, this Court rules as follows:
Main Text
The check listed in the attached table is declared invalid.
Litigation costs shall be borne by the petitioner.
Facts
The petitioner’s grounds for the petition are briefly as follows: The petitioner possessed the check listed in the attached table. Because it was lost, the petitioner previously petitioned this Court for a public summons under Case No. 99 Si Cui Zi 461, which was published in a newspaper. The prescribed period for filing claims has now expired, and no one has filed a claim or presented the original check. The petitioner therefore petitions for a declaration that the check is invalid.
Reasons
I. The above check was the subject of a public summons pursuant to this Court’s ruling in Case No. 99 Si Cui Zi 461.
II. The prescribed period for filing claims expired on March 24, 2011, and to date no one has filed a claim. The petitioner’s petition should therefore be granted.
III. Pursuant to Article 564, Paragraph 1 of the Code of Civil Procedure, the judgment is rendered as stated in the main text.
