Taiping branch. Working hours are divided into 10:30–20:30 and 11:30–21:30. I didn’t ask about the salary, but I guess it should be the minimum wage of NT$24,000.
Me: Don’t you have a break in between?
Them: We have a one-hour break in the afternoon, but you’re not allowed to leave the store, and they won’t let you take the whole break at once. It will be split into 30 minutes, 15 minutes, and 15 minutes for you to finish.
Definition of break time:
This refers to time during which workers are free from the employer’s direction and supervision and may use the time freely. When workers work outside the business premises as agreed, the employer must still provide them with break time in accordance with Article 35 of the Labor Standards Act. Unless the employer requires workers to continue working during their break, or the worker can prove that they worked during the break at the employer’s request, the break is not considered working time.
Therefore, if the employer requires employees to eat and rest in a designated place at the company, without allowing them to be free from supervision, the time is still considered standby working hours. For example, if an employee eats inside the store and must immediately serve customers whenever someone enters, this is not considered break time.
If the employee does not have a clearly specified break period—that is, time not controlled by the employer that the employee can use freely—it does not count as break time.
Therefore, a clear definition is necessary. The store manager should schedule each day’s meal times.
Moreover, this type of working time will be included in extended working hours (overtime) when calculating hours.
