Jin-Hong Technology sued an employee and lost the lawsuit.
Jin-Hong Technology Co., Ltd.
Unified Business No.: 28113005
Person in charge: Zheng Zhu-Ming
After looking through the judgment, the story goes like this:
An employee spent money to buy company shares. Later, the employee resigned.
Jin-Hong Technology wanted to spend money to buy back the shares. However, Jin-Hong Technology did not buy them back at a higher price; it bought them back at a low price.
If the stock price rose, Jin-Hong Technology would buy it back at a relatively lower price.
If the stock price fell, Jin-Hong Technology would still buy it back at a relatively lower price.
The Hsinchu court’s findings:
The share subscription agreement signed by both parties did not stipulate that the company could buy back the shares.
The shares belonged to the employee, so whether to sell them was, of course, the employee’s freedom.
As for how much Jin-Hong Technology should pay, that point was unimportant and did not need to be discussed.
In the end, Jin-Hong Technology lost the lawsuit.
Jin-Hong Technology also requested provisional enforcement at the same time. The court naturally dismissed that request as well.
